Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Wakr mobile application (the "App") operated by NenXYZ ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Wakr is a social alarm application that allows users to create alarm squads, track wake-up streaks, and hold each other accountable for waking up on time. The App is available on a freemium basis with optional in-app purchases.

3. Account Registration

You must create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information.

4. In-App Purchases

• The App may offer premium features through in-app purchases and subscriptions.
• All purchases are processed through Apple's App Store and are subject to their terms and conditions.
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
• Refunds are handled by Apple according to their refund policy.

5. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Interfere with or disrupt the App or its servers
• Attempt to gain unauthorized access to any part of the App
• Upload or transmit malicious code or content

6. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, and software — are owned by NenXYZ and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

7. User Content

You retain ownership of content you create within the App (e.g., profile information, squad names). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the App.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the App will be uninterrupted, error-free, or that alarms will always trigger as expected. You are ultimately responsible for waking up on time.

9. Limitation of Liability

To the maximum extent permitted by law, NenXYZ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to missed alarms, oversleeping, or any consequences thereof.

10. Termination

We may suspend or terminate your account at our sole discretion, without notice, for conduct that violates these Terms or is harmful to other users or the App. You may delete your account at any time.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App. Continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Germany.
